Often married couples contemplating divorce will reach a
separation agreement. This agreement will divide some or
all property among the two parties, establish a child custody
arrangement, and determine if there will be any spousal support.
In the State of New Jersey, spousal support (alimony) is
based upon the financial resources and needs of the parties,
the division of assets is based upon equitable distribution.
There is no automatic formula to divide property between husband
and wife. Instead, property such as homes and pension plans
are divided based on factors including the length of the marriage,
the financial situation of the parties, and the age of the parties.
Therefore, in a short term marriage, 1 to 3 years, spousal support
is usually not awarded, however an equitable distribution of assets
may be necessary. The longer a couple has been married the less
you have to show who contributed to the asset, all assets are
considered to be commingled.
Sometimes asset division is difficult to determine because one
of the spouses has hidden assets. In these instances investigators
may be hired to locate the hidden assets. In addition, an
experienced accountant may be retained to perform business and
asset valuations.
